The contract analysis determines the content of the contract: What should be done and what are the boundary conditions.

The risk analysis considers the risks and opportunities, on the one hand a commercial assessment and on the other hand a reduction of the risk should be achieved through the methods of the risk management.

Identifying risks as far as possible before signing the contract and then taking appropriate measures to minimize them is an essential key to success.

From contract analysis to project strategy

Every project requires an adapted strategy development. A strategy presupposes an objective and the knowledge of the special boundary conditions. This includes a clear analysis of the contract and the opportunities and risks it contains.

Furthermore, the respective strengths and weaknesses of the parties involved are to be determined as a basis for finding a strategy. A successful strategy can only be developed and implemented when all the relevant information has been gathered.

Strategic conflicting goals

Several strategies can certainly compete with one another in a project. The following subdivision is regularly the case:

  • Corporate strategy
  • Project strategy
  • Sub-strategies

The corporate strategy is defined by the management. It is entirely possible that this strategy creates a conflict with the project strategy. Typical cases are, for example, the new order that is currently being negotiated and the default claim that the project manager would like to implement against the same client.

This workshop is aimed at all employees who have responsibility in projects (e.g. project managers, engineers, commercial employees, controlling, purchasing). This seminar is suitable for non-lawyers.

Seminar content

A workshop in which the principles of claims management are deepened using practical examples. The claim process is practiced by creating and presenting claims in group work. It is also about the defense of claims and fundamental questions about the meaningful organization of claims management in the project.
